SANDAKAN: A 52-year-old Filipina walked out a free woman on Thursday after the High Court, here, released her from a charge of trafficking 370.37gm of syabu.
Sinang Paradji was discharged and acquitted by Judge Celestina Stuel Galid without her defence being called.
Celestina held that she found the prosecution had failed to establish a prima facie against Sinang.
Sinang, who holds an IMM13 document, was accused of committing the offence at 4.35pm on Oct 7, 2017 at the bus stop at Bandar Leila, here.
The charge under Section 39B (1)(a) of the Dangerous Drugs Act carries the death sentence, on conviction.
The prosecution had called eight witnesses to testify during the trial.
The court ordered Sinang to be referred to the Immigration Department.
Deputy Public Prosecutor Franklin Ganggan Bennet appeared for the prosecution while Sinang was represented by counsel Mohamed Zairi Zainal Abidin.
