SANDAKAN: A 28 year old local man was sentenced death by the High Court here for having 58.16g of methamphetamine in 2018.Judge, Dr. Lim Hock Leng found the accused, Ashfieq bin Mohamad had failed to cast a reasonable doubt on the Prosecution’s case and also failed to rebut the presumption of trafficking in dangerous drugs.
Based on the case fact, the accused was arrested by a team of policemen from Narcotic Criminal Investigation Department (NCID) on 10 June 2018 at about 4pm, located at the roadside of Mosque Kampung Tinusa 2, Mile 7.
Ashfieq was found trafficking 58.16gram methamphetamine in a pink plastic that was seized from his motorcycle’s carrier during the raid.
Therefore, he had committed an offence under Section 39B(1) (A) of the Dangerous Drugs Act 1952 (Act 234) and punishable under Section 39B(2) of the same Act.
Hence, the Judge found the accused guilty of the charge against him and convicted him accordingly.
