Kota Kinabalu: An entertainment outlet caretaker was fined RM3,000 or four months jail by the Magistrate’s Court, Friday, for running an entertainment centre without a licence.
Denny Geoffred, 29, admitted before Magistrate Lovely Natasha Charles to committing the offence at the Litez & Ezy, at HS Commercial Centre, Penampang at 12.40am on Jan 8, this year.
Inspector Kelvan Elson Maik informed the court that the police acting on information, inspected the outlet and found the music still playing loudly with several customers inside.
The music instruments were seized and Denny, who was the caretaker was detained for the offence.
Denny was charged under Section 3 of the Public Entertainment Ordinance 1958 which provides for a fine of up to RM50,000 or up to one year jail or both, on conviction.
Duty counsel Lim Ming Zoong @ Lawrence requested a lower fine on the grounds that Denny has a wife and two children to support.
Kelvan applied for an adequate sentence.
Meanwhile, seven people were penalised for committing drug-related offences.
Lerry Joy, Julfadli Ekju, Arham Marjuni and Chung Ket Luen admitted to having syabu last year, as framed under Section 12 (2) of the Dangerous Drug Act 1952
Lerry was fined RM2,700 or six months jail, Julfadli and Arham were jailed 10 months each, while Chung was handed nine months jail. The charge framed against them provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
The other three Abdul Majid, Madzlan Sharif and Johari Habidin pleaded guilty to taking syabu at separate locations here between Sept 9, 2021 and Nov 17 the same year.
Madzlan was sentenced to eight months’ jail while Abdul and Johari were handed six months jail each.
They were charged with taking syabu as framed under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
