Kota Kinabalu: A company and two men, who were charged with offences under the Occupational Safety and Health Act 1994, will go on trial for five days commencing Feb 21.
The case of the Sabah Electricity Sdn Bhd, which was represented by a representative and Jusdi Justin, an area manager, came up for final management and pre-trial case management, respectively before Sessions Court Judge Noor Hafizah Mohd Salim on Thursday.
Their trial date which was fixed on Sept 8, 2021, is also confirmed to proceed on Feb 21- 25.
Earlier, the court set Feb 10 for mention for the prosecution to supply the questions in related documents.
The company and Jusdi were jointly accused as employers failed to ensure their duties, so far as is practicable, that a victim one AgKu Sallam Awangku Amas, not being their employees, who may be exposed to risks to their safety or health by allowing Sallam to work in a hazardous situation without the appropriate safety equipment to repair a broken line at Mondikot river, Kg Mondikot in Papar between 11.15am and 2.35pm on July 1, 2020.
Both accused had on Dec 22, 2020 claimed trial to the charge under Section 17(1) of the Occupational Safety and Health Act which provides for a fine of up to RM50,000, or a jail term of up to two years, or both, on conviction. The prosecution is expected to call five witnesses to testify in the trial.
In a related case, the case of a sub-contractor charged with Section 15(1) of the same Act will be mentioned on Feb 10 for case management.
Mohd Redhwan Liman, was accused as an employer who failed to ensure the safety, health and welfare at work of all his employees especially one AgKu Sallam Awangku Amas by allowing him to work in dangerous conditions without appropriate safety equipment to repair the broken line at the same place and same time.
The charge provides for a fine of up to RM50,000 or a jail term of up to two years, or both, on convictio. Redhwan had on Dec 28, 2020 claimed trial to the charge.
Prosecuting officers from the Department of Occupational Health and Safety Jinurah Sintian and Elisa Samuel prosecuted.
The company and Jusdi were represented by counsel Rofendy Rauf while Redhwan was represented by counsel Mohd Ari Nadzrah Abd Rahman.
