Man fined for flouting CMCO
PAPAR: A 28-year-old man was fined of RM5,500 or two months jail by the Magistrate’s Court here for crossing districts without a permission letter during the Conditional Movement Control Order (CMCO) last year.

Mohamad Amirakhan Nasib pleaded guilty before Magistrate Afiq Agoes to violating the instructions of the Director-General of Health by committing the offence at 6.30pm on July 15, 2021 at KM30 Jalan Lama Papar – Kota Kinabalu, here.

Amirakhan was charged under Rule 17(1) of the Prevention and Control of Infectious Diseases Rules 2021, which provides for a fine of up to RM50,000 or up to six months jail or both on conviction.

Prosecuting officer John Raynold Achon in tendering the facts of the case, told the court that Amirakhan was found by the police who conducted an Ops Covid-19 roadblock at the said place to have defied the CMCO by having no cross district permission letters. Amirakhan was then issued a compound under the Prevention and Control of Infectious Diseases (Measures within the Infected Local Areas) (Recovery Movement Control) Regulations 2021.

Amirakhan requested a lower fine by saying that he is the eldest child of eight siblings and is still studying and also having health problems.

John applied for an appropriate sentence as a lesson to Amirakhan and to the public to always abide by every rule set by the government to curb the spread of Covid-19 in the community.

“This situation occurred when the country was hit by the Covid-19 pandemic and the action taken by the accused was in defiance of government directives.

“This is an offence that can be compounded but he failed to pay the compound according to the stipulated time,” said John. Amirakhan paid the fine.
