Kota Kinabalu: A 56-year-old man charged with sexually harassing his stepdaughter will go trial on Jan 20 and 27, next year.
Sessions Court Judge Azreena Aziz set the date for the man who maintained his not guilty plea during the pre-trial case management on Monday.
The man is accused of committing the offence by inserting his private part into the 13-year-old girl’s private part at 2.30pm on Nov 1, 2021 at a house in Penampang.
The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.
Due to relation between the man and the alleged victim, the man will face additional punishment under Section 16(2)(c ) of the same Act which carries a jail term of up to five years and whipping of at least two strokes on conviction.
Deputy Public Prosecutor Siti Hajar Mazlan appeared for the prosecution while counsel Ram Singh together with Kimberly Ye defended the man.
In another case, a 31-year-old Pakistani was charged with violating the condition of his social visit pass by working at a shop.
Faisal Shah pleaded not guilty to breaching the condition of his pass on March 25 this year at 2.17am at the Malindo Mart in Kg Bantayan, Jalan Sungai Damit, Tamparuli.
The court set May 19 for case management and Sept 27 for hearing the case.
Faisal was released on a bail of RM1,000 with two local sureties who has permanent job and address, as well as his passport to be impounded by the court, pending the date. The court also warned Faisal not to tamper with the prosecution witnesses.
