Man gets 6 years, fine for having bakakuks, bullets
Kota Kinabalu: A 39-year-old man was jailed a total of six years and fined RM6,000 for having weapons and live bullets.

Sessions Court Judge Ummu Khaltom Abd Samad handed the sentence to Kennylly Kohaman who pleaded guilty to the alternative charge, Wednesday.

On the first count, Kennylly was jail three years and fined RM3,000 or four months’ jail for having two Bakakuks at 9.30pm on Sept 10, 2021 at a house in Kg Kigiok, Ranau.

On the second count, he was ordered to serve a jail sentence of three years and fined RM3,000 in default four months’ jail for having eight live Bore-type bullets at the same place and time.

The offence under Section 8(a) of the Arms Act 1960 provides a jail term of up to seven years, and a maximum fine of RM10,000 or with both, on conviction.

Kennylly was ordered to serve the jail sentence concurrently.

In mitigation, counsel Hairul Vaiyron together with Luke Ressa Balang who defended Kennylly, asked for non-custodial sentence to be imposed as a second chance not only for Kennylly but for his family.

Hairul said Kennylly needed to look after his family.

To a question by the court, Hairul explained that prior to the arrest, Kennylly actually manufactured the bakakuk.

In reply, Deputy Public Prosecutor Mohammad Fauzi Acho urged for a deterrent sentence due to the seriousness of the offence which may harm those around him as well as the society at large if there’s no proper guidance or knowledge in handling weapons.
