Kota Kinabalu: A 34-year-old man was sentenced to 10 months’ jail by the Magistrate’s Court here, Thursday, for keeping stolen properties.
Rabuan Sehan pleaded guilty before Magistrate Lovely Natasha Charles to having a laptop bag, backpack, digital camera and its casing which were all stolen from its owner at 3.30pm on Feb 2, this year in a house at KKIP housing area, Sepanggar Manggatal.
The prosecution told the court that the properties were reported stolen from a house at Taman Ujana Kingfisher, which was broken into earlier on Jan 24.
Rabuan was charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.
Duty counsel Lim Ming Zoong @ Lawrence, representing Rabuan requested a lenient sentence as he is married with one child and applied for the sentence to run from the date of his arrest since he could not post the bail offered to him previously.
Inspector Kelvan Elson Maik applied for an adequate sentence.
The court ordered Rabuan to serve the jail term from the date of his arrest.
In another case, eight people were penalised for committing drug-related offences.
Furkan Mokti, Faiz Saripudin, Hilarius Laru, Zainudin Baily, Fadzil Abdul and Lyn Garan admitted to taking syabu and amphetamine at separate locations here and in Penampang between Jan 30 and March 3, this year.
Furkan was fined RM2,300 or seven months’ jail while the rest were handed seven months’ jail each.
The six had committed an offence under Section 15(1) of the Dangerous Drugs Act which provides for a fine of up to RM5,000 or up to two years’ jail on conviction.
Meanwhile, Lyn, Aminul Nurhusin and Chong Kar Meng pleaded guilty to having syabu weighing between 2.60gm and 0.07gm between Oct 30, 2021 and Jan, 30 this year.
Aminul was sentenced to one year and three months’ jail, Lyn nine months’ jail while Chong was fined RM2,700 or 11 months’ jail.
They were charged under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years’ jail, or both, on conviction.
