Kota Kinabalu: A 31-year-old single father, who confessed that he stole a pack of Milo to sell to get money, was jailed three months.
Magistrate Lovely Natasha Charles meted out the sentence to Yassin Muhammad Nur who pleaded guilty to the charge against him on Friday.
The court ordered Yassin to serve the jail sentence from the date of his arrest on April 9 this year.
Yassin stole the instant drinks at 2.30pm on April 9 this year at the KWC The Grocer premise in Asia City, here.
He was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years or with fine on conviction.
During mitigation, Yassin, through his Counsel Lawrence Lim from the National Legal Aid Foundation, asked for leniency saying that he is a single father and needed to look after his child.
Lim said Yassin had committed the offence because he was desperate for money at that time.
However, Inspector Kelvan Elson Maik urged the court to impose an appropriate sentence.
The court heard that on that day while the complainant in that case who was a cashier of the shop was working, an unknown man entered the shop, took one pack of instant drink containing 18 sachets and left the shop without making any payment.
The cashier and her friend tried to stop him from taking away the instant drinks, but the man later identified as Yassin then threatened to stab them.
Following a police report lodged by the complainant, Yassin was arrested at a stall in Kg Air, here, where the instant drinks were also recovered.
Investigation revealed that Yassin took the instant drinks without making payment.
