Kota Kinabalu: A 41-year-old man, charged with the murder of a man in Kudat, was ordered to enter his defence.
Judicial Commissioner Amelati Parnell made the order on Donny @ Mohd Nazmie Musanna on Friday, ruling that the court was satisfied that the prosecution had established a prima facie case against him.
Amelati set July 28 for Donny’s defence.
Donny was accused of murdering one Ampukir Aladau, 64, at 12.30am on March 26, 2019 at the Tamu Tomborungus area in Kudat. The charge, under Section 302 of the Penal Code, carries the death penalty on conviction.
The prosecution had called 13 witnesses to testify at the prosecution’s stage.
Counsel Amli Nohin representing Donny said the defence would be calling three witnesses.
Donny was ordered to be remanded further as the charge framed against him has no provision for bail.
