Kota Kinabalu: A company was charged with failing to securely cover an elevator door opening which caused an accident.
TK Elevator Malaysia Sdn Bhd pleaded not guilty through its representative before Sessions Court Judge Noor Hafizah Mohd Salim, to the charge against the company on Monday.
The company as a sub-contractor, is accused of failing to securely cover or fence the elevator door opening as to prevent risk of persons falling.
The offence allegedly took place at 11.36am on Jan 14 this year at the elevator door number 4 at the sixth floor of the Propose 25 Storey Mixed Commercial Development (with Subsidiary titles to be applied for) at Jalan Tun Fuad Stephen, here.
The company was charged under Section 10 (e) Factories and Machinery Act 1967 and punishable under section 51 (2) of the same Act which provides for a fine of up to RM50,000, or a jail term of up to one year, or both.
The court set June 8 for e-review and the representative of the company was released on a bail of RM2,000 in a local surety with permanent address and job.
Prosecuting Officer Jason Liew from Department of Occupational Safety and Health appeared for the prosecution.
Meanwhile, in another case, a man was charged with taking syabu repeatedly.
However, no plea was taken from Mahani Sikin @ Jaudin pending the pathology and previous conviction records.
The court fixed June 22 for mention and ordered Mahani to be remanded further pending the date.
