Kota Kinabalu: A 33-year-old unemployed man was charged in the Magistrate’s Court here, Thursday, with drug trafficking.
Hafiz Yusof was accused of trafficking 75.18gm of syabu at 5.50pm on May 12 this year at a car park in front of Ani Sup Utara shop at University Utama Condominium (UUC), Jalan Kayu Madang, Manggatal.
However, no plea was taken from Hafiz, who appeared before Magistrate Lovely Natasha Charles after the charge was read out to him.
The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected bail for Hafiz as the charge has no provision for bail.
Lovely fixed June 24 for mention and ordered Hafiz to be further remanded.
In another case, a food deliveryman was charged with assaulting his wife.
Ronny Lee Tommy, 26, was accused of committing the offence to his 21-year-old wife at 1.40pm on May 15 this year in a unit at Seri Maju Apartment, Sepanggar.
Ronny pleaded not guilty to the charge under Section 323 of the Penal Code read together with Section 326A of the same Code.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000, or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.
Inspector Kelvan Elson Maik, prosecuting, in applying for a mention date proposed bail at RM3,000 with an additional condition that the accused would not tamper with the complainant.
The court set June 24 for case management and released Ronny on a bail of RM1,300 in two sureties and granted the condition applied by the prosecution.
Ronny was also charged with taking drugs framed under offence under Section 15(1) of the Dangerous Drugs Act which provides for a fine of up to RM5,000 or up to two years jail on conviction.
However, no plea was taken from him pending the availability of the chemist’s report. Lovely set June 24 for e-review and offered him bail at RM1,200 in two sureties.
