Kota Kinabalu: A 53-year-old man was ordered to enter his defence on a charge of killing his nine-month-old daughter.
High Court Judge Leonard David Shim made the order for Maidin Ibnuhashim after ruling that the prosecution has established a prima facie case against Maidin.
The court set July 26-29 this year for Maidin’s defence.
Maidin is accused of murdering the baby between Aug 10 and 13, 2018 at a rented room in Kg Gersik Lama, Labuan.
The offence under Section 302 of the Penal Code carries the death penalty on conviction.
The prosecution had called 15 witnesses during the hearing.
Deputy Public Prosecutor Rustam Sanip conducted the prosecution while assigned counsel David Tan represented Maidin who was further remanded.
Meanwhile, three men were jailed five years and ordered to get a stroke of the cane each for taking drugs repeatedly.
Ozzy Kairull Jain, Azri Sakmat and Abdul Adi Masin pleaded guilty separately before Sessions Court Judge Noor Hafizah Mohd Salim to the charges against them.
Ozzy was found taking drugs on Feb 25, 2021 after his urine was tested positive at the Penampang police station.
Azri and Abdul were found taking drugs on March 6 and 16 after their urine were tested positive at the Tuaran police station, respectively.
The trio have several conviction records for taking drugs.
The offence under Section 39C(1) of the Dangerous Drugs Act 1952 provides for a jail term of between five and seven years, and whipping, on conviction.
The court ordered the trio to be placed under police supervision for two years after serving their jail sentences.
They were ordered to serve their jail sentences from the date of their arrests.
