Kota Kinabalu: Two siblings charged with murdering a 19-year-old, will go trial on March 27-30 next year.
High Court Judicial Commissioner Amelati Parnell set the date for Halil Mastar, 24, and his stepbrother Hendrey Jul, 27, when their case was brought up for pre-trial case management, Wednesday.
The court also fixed another case management on Aug 30 this year. The duo is accused of killing Samsul Robert at 11.30pm on Nov 14, 2019 at the bridge of Kg Numbak, Manggatal, near here.
The offence under Section 302/34 of the Penal Code carries the death sentence, on conviction.
Deputy Public Prosecutor Azreen Yas Mohamad Ramli appeared for the prosecution while assigned counsel Hamid Ismail for Halil and counsel Goldam Hamid for Hendrey.
The siblings were ordered remanded further pending the disposal of their case as the charge against them has no provision for bail.
Meanwhile, a 36-year-old man was fined a total of RM4,000 for having unregistered products and cosmetics without labels.
Sessions Court Judge Azreena Aziz handed the sentence to Mahathir, who pleaded guilty to the charge against him.
On the first count, Mahathir was found having 10 types of unregistered products at 11am on June 15, 2017 at the Originz Bundle in Karamunsing Complex, Jalan Tuaran, here.
Among the products were Surut Ayu, Freshcare Splashfruity, Freshcare Greentea, Freshcare Lavender, Pure Slim 7D, Kacip Malam, Minyak Tradisi Lintah Gunung Asli, Minyak Belacak Original Warisan, V-C Injection and Perlaking.
For the offence, Mahathir was fined RM2,000 in default two weeks’ jail.
The offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952 which carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.
On the second count, Mahathir was fined another RM2,000 or spend two weeks in prison for having 15 types of cosmetics without labels at the same place and time.
During mitigation, Mahathir who was not represented, asked for leniency.
However, Prosecuting Officer Amira Diyama Rosman from the Pharmacy Department urged the court to impose an appropriate sentence as Mahathir had committed the offence which could risk the public’s health as the products did not registered to the Health Ministry and the cosmetics had no labels.
The court granted Mahathir’s application to pay the fine by instalment and the first payment was RM1,000 and the balance of RM3,000 must be paid before or on Aug 29 this year.
