Selling products containing poisons: Pakistani gets fine
Kota Kinabalu: A 33-year-old Pakistani was fined a total of RM3,800 for selling products containing poisons without licence, unregistered products and cosmetics without labels.

Najeem Khan pleaded guilty before Sessions Court Judge Noor Hafizah Mohd Salim, to the three charges against him, on Friday.

On the first count, Najeem was fined RM800 in default 30 days’ jail for having for sale five products containing poison in which she had no licence to sell at 11.30am on Oct 23, 2019 at the Never Close mini Store in Jalan Tugu, Kg Air, here.

The charges stated among the poisons detected in the products were Tadalafil and Lignocaine which are listed in the First Schedule of the Poisons Act 1952.

The offence under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act carries a fine of up to RM3,000, or a jail term of up to a year, or both, upon conviction.

On the second count, Najeem was ordered to pay a fine of RM1,500 or 30 days’ jail for having 10 unregistered products at the same place and time.

On the third count, he was fined another RM1,500 or 30 days’ jail for having for sale one cosmetic without labels at the same place and time.

During mitigation, Najeem who was not represented, asked for leniency saying that he has six children to look after.

Prosecuting Officer Liaw Zhan Yit from the Pharmacy Department urged the court to impose an appropriate sentence as Najeem had committed the offence which could risk the public’s health due to his act.

In another case, a 25-year-old woman was fined RM1,800 or spend 10 days’ jail for selling product containing poison without licence. Sessions Court Judge Ummu Khaltom Abdul Samad meted out the sentence to Aida Ruding who pleaded guilty to selling candy B+ Complex containing Tadalafil, at 11.30am on Oct 23, 2019 also in Kg Air, here.
