Kota Kinabalu: A 44-year-old Pakistani was fined RM6,000 for committing pharmacy-related offences.
Irfan Khan Mir Akbar pleaded guilty before Sessions Court Judge Ummu Khaltom Abdul Samad, to four charges against him.
On the first count, he was fined RM800 or 15 days behind bars for selling products which was Candy B+ Complex containing Tadalafil poison, by retail without licence at 2.30pm on Oct 9, 2019 at the Bilal Enterprise in Cyber Square in Kg Sunduow, Kepayan.
The Tadalafil poison is listed in the First Schedule of the Poisons Act 1952.
The offence under Section 16(1) of the Poison Act 1952 and punishable under Section 32(2) of the same Act which provides for a fine of up to RM3,000, or jail of up to a year, or both, on conviction.
On the second count, Irfan was ordered to pay a fine of RM1,200 or 30 days’ jail for illegally having for sale Candy B+ Complex containing Tadalafil poison at the same place and time.
On the third count, he was fined another RM3,000 in default 45 days’ jail for having for sale seven types of unregistered products at the same place and time.
Among the products were 18 boxes of Freshcare Lavender, 13 boxes of Freshcare Strong, 12 boxes of Freshcare Sports, 11 boxes of Freshcare Citrus, ten boxes of Freshcare Greentea, three boxes of Blue Wizard and 23 boxes of BL.
On the fourth count, Irfan was fined RM1,000 or spend 30 days’ jail for having two types of cosmetics namely, 12 boxes of Jiaoli and nine boxes of Collagen Plus Vit E, without notification at the same place and time.
Prosecuting Officer Lai Teck Peng from the Pharmacy Department urged the court to impose an appropriate sentence as Irfan had committed the offences which could risk the public’s health due to his act.
