Kota Kinabalu: A 30-year-old security guard was sentenced to five years and three months’ jail and ordered to get a stroke of the cane for having a knife in the public without permit.
Sessions Court Judge Elsie Primus meted out the sentence to Mohd Syukri Tamat who changed his plea and admitted to the charge against him during his trial on Friday.
Mohd Syukri had in possession the 11-inches of knife without permit at 7.45am on Sept 18, 2021 in front of the Malaysian Maritime Enforcement Agency main entrance in Jalan Kolombong, Inanam.
The offence, under Section 6(1) of the Corrosive and Explosive Substances and Offensive Weapons Act 1958, carries a jail term of between five and 10 years, and whipping, on conviction.
The court ordered Mohd Syukri to serve the jail sentence from the date of his arrest on Sept 18, 2021.
During mitigation, Mohd Syukri asked for leniency and the sentence to be run from the date of his arrest.
However, Deputy Public Prosecutor Tham Pou Jin urged the court to hand down a deterrent sentence on the grounds that Mohd Syukri had committed a serious offence by carrying a dangerous weapon in the public without permit and no valid reason.
Tham added that Mohd Syukri had wasted time of court and witnesses as he only admitted to the charge when the trial just started and the four witnesses had already come to court.
Meanwhile, a 36-year-old rubber tapper was charged with committing mischief by burning his neighbour’s shoe rack.
However, no plea was recorded from Laimus Yampat after the charge was read to him.
Laimus is accused of committing the offence by burning the shoe rack which belonged to one Peter Timbun, 46, at 10am on June 24 this year at a house in Kg Terintidon, Kota Belud.
The court set Aug 9 for mention and no bail was offered to Laimus pending the date.
