Kota Kinabalu: A 44-year-old man was fined RM3,000 or two weeks’ jail for having for sale four types of whitening and brightening products which were not registered with the Health Ministry.
Sessions Court Judge Azreena Aziz imposed the sentence on Abu Barra Berahim who pleaded guilty.
Abu was found having the unregistered products at 7.30pm on Nov 29, 2019 at the Hanney Ladys Shop at Megalong Commercial Centre, Penampang.
The unregistered products were 17 boxes of Wink White Morosil S, seven boxes of Wink White Gluto Pancea, five bottles of Colla Rich Collagen and three containers of Prime CL Tri-Peptide.
Abu committed the offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 which is punishable under Section 12(2) of the Sale of Drugs Act 1952 and carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.
Abu, who was not represented, asked for leniency saying that he did not know that the products could not be sold.
However, Prosecuting Officer Lavinia Kong Jin Qi from the Pharmacy Department, urged the court to impose an appropriate sentence to protect the safety and health of the public.
Kong submitted that all medicine must be registered with the Health Ministry as the purpose of registration is to ensure the safety and quality of the product for public use.
She added that by committing such offence, it could risk the public’s health as the products were not registered with the Health Ministry.
