Kota Kinabalu: A 23-year-old security guard, whose wife is currently five months pregnant, was charged with raping an underaged girl.
Hanafie Roslan pleaded not guilty before Sessions Court Judge Noor Hafizah Mohd Salim, to the charge, Wednesday.
He is accused of raping the 15-year-old girl in August 2020 at a house in Taman Sri Rugading, Tuaran.
The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.
The court set Sept 5 this year for e-review to know the status of the DNA report.
Pending the date, Hanafie was released on a bail of RM10,000 in two local sureties as well as to report to Tuaran Police Station every first and third Friday of the month.
The court warned Hanafie not to communicate with any of the prosecution witness and failure to adhere to all the conditions, bail could be revoked.
Earlier, Deputy Public Prosecutor Nur Faezah Jafry proposed bail of RM15,000 with additional conditions to be imposed on Hanafie.
However, counsel Ari Nadzrah, in asking for the bail sum to be reduced, said his client was not a habitual offender and has no previous conviction or acquittal records.
Ari added that Hanafie was not a flight risk and not a passport holder.
He informed the court that Hanafie would not tamper with the witnesses as the main witness is living in Labuan and Hanafie is staying in Kota Belud.
