Mechanic jailed and fined for assaulting wife in Penampang
He had on July 26 claimed trial to the charge under Section 323 of the Penal Code read together with Section 326A of the same Code.
Kota Kinabalu: A 37-year-old mechanic was jailed a day and fined RM3,000 or 10 months jail by the Magistrate’s Court here for assaulting his wife.

Lee Nyen On changed his plea to guilty before Magistrate Stephanie Sherron Abbie during case management of his case, Thursday.

Lee admitted to causing hurt to his 33-year-old wife at 4pm on June 22 this year at Kg Madsiang, Penampang.

He had on July 26 claimed trial to the charge under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to a year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

Lee requested leniency while Inspector Suzie @ Stephanie Kupit applied for an adequate sentence.

Meanwhile, a security guard was fined RM1,500 or two months jail for attacking a man last year.

Affendy Voo, 25, pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence to Iskhandar Lamrin at the entrance gate of the UUC Apartment, Jalan Kayu Madang at 12.30pm on June 24, 2021.

Voo was also charged under Section 323 of the Penal Code which provides for a jail term of up to one year or a fine or both, on conviction.

Inspector Albert Basiri prosecuting, informed the court that the incident occurred when the bar at the main gate was not raised when the complainant wanted to enter the residential area.

The complainant, who lived in the area for about two years, shoved the bar, causing damage, and this angered the security guards.

A heated argument ensued which ended with one of the security guards, Voo, punching the complainant’s face and head, the court heard.

Duty counsel Nabila Norsahar requested leniency by submitting, among others, that based on Voo’s story at that material time, the victim himself had contributed to the fight as he failed to obey the apartment’s rules, where the victim needed to wait until the gate is open but the victim decided to crash it.

Nabila said Voo was remorseful over his action as it was unprofessional and acted aggressively towards the victim and that Voo now realised that he was acting emotionally at that time due to the victim’s actions.

The victim also did not suffer any serious injuries and no bruises were found, said Nabila.
