Kota Kinabalu: A 35-year-old man was tentatively charged in the Magistrate’s Court, here, with drug trafficking.
Jobless Mohd Nizam Alimin is accused of trafficking 51.48gm of syabu at 12.10am on Aug 19, this year next to the third staircase of block F, Rainfield Court, in Penampang.
However, no plea was taken from Nizam, who appeared before Magistrate Jessica Ombou Kakayun, after the charge was read out to him.
The charge, under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.
The prosecution applied for a new mention date while waiting for the chemist’s report and objected to bail for Nizam as he was charged with capital punishment.
Jessica fixed Oct 11 for mention and ordered Nizam, who was not represented, to be remanded further.
In another case, a 28-year-old woman was fined RM2,000 or two months’ jail for engaging in gambling sessions.
Junha Basir, an IMM13 holder pleaded guilty to buying illegal lottery tickets at 2.33pm on April 19, this year at a premises at the Donggongon new township in Penampang.
Junha had committed an offence under Section 9(1) of the Common Gaming House Act, which carries a jail term of up to six months or a fine of up to RM3,000, or both, on conviction.
The court was informed by the prosecution that Junha was arrested by police, who acted on information on gambling activity at the said place.
Gambling paraphernalia including the lottery slip, a mobile printer, a handphone and RM131 were also seized from Junha, the court heard.
Meanwhile, a 38-year-old man was charged with cheating another man of RM6,000.
Mahadir Abdullah is accused of cheating one Adsman Andi by making him believe that he (Mahadir) could speed up the citizenship verification process and fraudulently induced Adsman to hand over RM6,000 cash to him at 11am on July 7, this year at the Federal Administrative Complex here.
Mahadir, who is helping his wife’s business, pleaded not guilty before Magistrate Stephanie Sherron Abbie to the charge under Section 420 of the Penal Code.
The court fixed Oct 4 for case management and released the accused on a bail of RM2,500 in two sureties.
