Kota Kinabalu: Two men who robbed a woman, attempted to rape her, molested her and asked her to perform oral sex, were jailed and whipped.

Awang Mohammad Fazri Said, 25, and Hafis Durahaman, 30, pleaded guilty separately before Sessions Court Judge Azreena Aziz, to the charge of robbing the 35-year-old woman by using a knife.

The court handed 10 years’ jail plus a stroke of the cane for each of them.

The duo had robbed the woman of her iPhone 7-Plus and RM200 cash between 9am and 10am at a house in Penampang.

The offence under Section 395/397 of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

Awang was sentenced to another six years’ jail and ordered to get a stroke of the cane for attempting to rape the victim at the same time and place.

He was also jailed for another 12 years plus one stroke of the cane for asking the woman to perform oral on him at the same time and place.

The court ordered the jail sentences for the sexual offences to be run concurrently but consecutively with the robbery charge.

Meanwhile, in another Sessions Court, Awang was jailed 24 months for keeping a stolen smartphone belonging to the woman.

Judge Noor Hafizah Mohd Salim meted out the sentence to Awang who admitted to keeping the stolen smartphone at 8.40pm at the Petronas petrol station in Kg Bakut, Tuaran on Aug 30 this year.

Noor Hafizah ordered Awang to serve the jail sentence from the date of his arrest on Aug 30 this year.

For Hafis, he was jailed another three years plus three strokes of the cane by Magistrate Stephanie Sherron Abbie for molesting the same woman during the robbery.

The court ordered Hafis to serve the jail sentence concurrently with his armed robbery case.

During mitigation, the duo separately asked for leniency saying that they have no job and need to look after their respective family as well as their elderly parents.

Hafis said his wife is three months pregnant while Awang said his wife was four months pregnant.

However, the prosecution urged the court to impose a deterrent sentence considering the seriousness of the offences.

All the cases were prosecuted by Deputy Public Prosecutor (DPP) Adibah Saiful Bahri, DPP Nur Faezah Jafry and Inspector Albert Basiri, respectively.

The court heard that while the victim was sleeping in the bedroom at about 10am, a man  entered her room and asked her to keep quiet before punching her face three times.

The man, later identified as Awang, was holding a knife and threatened to stab the woman if she shouted or fought back.

After a while, another man, later identified as Hafis, also entered the room and asked the victim to show them where the money and jewellery were kept.

The victim then took RM200 from her wallet and gave to the men.

During the incident, Hafis also molested the woman by fondling her breasts before leaving the room with the money and the IPhone 7-Plus.

Following a police report, Hafis was arrested on Aug 29 at 7.30pm at a rented house in Kg Kibabaig, Penampang while Awang was arrested the following day at 8.40pm at the petrol station in Kg Bakut, Tuaran.

The stolen items were also recovered from Awang.
