Kota Kinabalu: A shop owner and his assistant were fined a total of RM5,000 by the Sessions Court here for committing pharmacy-related offences.
Edwin Unding, 36, and Perenccey Endih, 35, pleaded guilty separately before judge Elsie Primus to committing the offences at 11.25am on Sept 10, 2019, at the Enabless Enterprise, Pinasang Shoplot, KK-KB Road, Mile 5, Kota Belud.
Edwin, the shop owner, was fined RM1,500 or one-month jail for having 57 boxes of ‘Novomin’ containing diphenhydramine, a type of poison scheduled under the Poisons Act 1952.
The offence, under Section 13(a) of the Poisons Act 1952, is punishable under Section 32(2) of the same act which provides for a fine not exceeding RM3,000 or imprisonment of up to a year, or both, on conviction.
Edwin, on the second count, was fined RM2,000 or one-month jail for having unregistered aromatherapy oil: 10 bottles of FreshCare Lavender, seven bottles of FreshCare Strong, four bottles of FreshCare Sports and eight bottles of FreshCare Sandalwood at the same premises on the same day.
Edwin was found to have violated Regulation 7(1)(a) of the Control of Drugs and Cosmetics Regulations 1984, an offence under Regulation 30(1) of the same Regulations and punishable under Section 12(1) of Sale of Drugs Act 1952 which carries a fine of up to RM25,000 or jail term of up to three years, or both, on conviction.
Meanwhile, assistant Perenccey was fined RM1,500 or one-month jail under the Poisons Act 152 for selling a box of ‘Novomin’. She was charged under Section 16(5) of the Poisons Act 1952 and punishable under Section 32(2) of the same act which provides for a fine not exceeding RM3,000 or imprisonment of up to a year or both, upon conviction.
Prosecuting officer from the Pharmacy Department Tan Pueh Li prosecuted while Edwin and Perenccey were unrepresented.
Edwin and Perenccey paid their fines.
