Kota Kinabalu: A businessman is seeking justice regarding an alleged fraud case involving a sand mining company in the state.
Henry Chia Chi Tshung claimed to have been defrauded of a total of RM2.42 million by the said company and despite various reports also being made, the authorities had not taken any action regarding the matter.
“Therefore, I now have a judicial review filed jointly with my wife Chan Yee Ling through Messrs Marcel & Co lawyers, early last month.
“The case was mentioned through a video conference on Oct 11, 2022, in front of High Court judge Wong Siong Tung, at the Kota Kinabalu High Court,” he said in a statement, here, Tuesday.
Chia was also informed by his lawyer that the Attorney-General’s Office will represent the parties who will file written submissions to oppose his and his wife’s application within a month from the date of the first hearing.
He explained that the judicial review was filed with the main purpose of contesting the ‘No further Action’ (NFA) decision made by the relevant parties on June 13, 2022, on the investigation of his removal as a director of the mining company being invalid.
In addition, 10 per cent of his wife’s shares (100,000 units) were transferred to a new employee in the company in March 2019, without going through the correct procedure as stipulated in the Companies Act 2016.
In the meantime, Chia also welcomed the decision of the Attorney-General’s Chamber to object to their application for a judicial review, which was confirmed by Senior Federal Counsel (SFC) Mohd Hafizi Abdul Halim following the hearing of the case which was conducted via zoom video conference on Oct 11, 2022.
“We are ready to fight for our case,” said Chia.
