Kuala Lumpur: Najib Razak’s application to review his conviction and jail sentence in the SRC International case will be heard in the Federal Court over three days in January next year.
Deputy public prosecutor Ashrof Adrin Kamarul said the hearing will take place on Jan 19, 20 and 26.
The dates were decided during an online case management proceeding conducted by deputy registrars Wan Fatimah Zahara Wan Yussof and Siti Hajar Mustaffa this afternoon.
“Parties are to file their written submissions on or before Jan 4,” he said.
Ashrof and ad hoc prosecutor V Sithambaram appeared for the prosecution.
Najib was represented by Shafee Abdullah, Farhan Shafee, Syafiqah Sofian and Wan Arfan Wan Othman.
Najib, 69, filed the review last month after the apex court affirmed his conviction for abuse of power, criminal breach of trust (CBT) and money laundering in the SRC International case.
A five-member bench chaired by Chief Justice Tengku Maimun Tuan Mat also maintained the former prime minister’s 12-year jail term and fine of RM210 million or, in default, an additional five years in prison.
Najib is asking for that decision to be set aside and for another Federal Court bench consisting of at least seven judges to rehear his appeal.
In his affidavit filed in support of the application, Najib said he had been advised by his solicitors that the decision of the Federal Court was reviewable pursuant to Rule 137 of the Federal Court Rules 1995.
That rule, he said, allows for a review if there had been a breach of natural justice or an abuse of process.
However, the prosecution claims Najib was given a fair hearing and that there had been no prejudgment of the merits of his final appeal by the Federal Court.
Ashrof, who affirmed the prosecution’s affidavit opposing the application, said the review application ought to be dismissed as there must be finality in criminal appeals.
