Kota Kinabalu: The Sessions Court here fixed January 5, 2023 for further pre-trial case management of a tyre factory worker charged with two counts of committing sexual assault against his two grandnephews two years ago.
Judge Noor Hafizah Mohd Salim set the date for the 49-year-old man when his case was brought up for serving of relevant documents pertaining to the case, on Monday.
On the first count, the man allegedly touched the private parts of the eight-year-old boy at a house in Tuaran between 1am to 4am on May 12, 2020.
On the second count, he is accused of committing a similar offence on the alleged victim’s brother aged 11 at the same time and place.
The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.
Due to relation between the man and the alleged victim, the man will face additional punishment under Section 16(1) of the same Act which carries a jail term of up to five years, and whipping of at least two strokes, on conviction.
The man is currently released on RM10,000 bail for each of the charge with two local sureties.
