Gang robbery: Man ordered to enter defence

Kota Kinabalu: A 33-year-old man was ordered to enter his defence on a charge of gang robbery.

Sessions Court Judge Noor Hafizah Mohd Salim made the order for Azif Hafizan Abdullah, after ruling that the prosecution had established a prima facie case against Azif.

In making the decision at the end of prosecution case, the court had perused and considered all the evidences and testimonies before her.

The court set Jan 24, 2023 for Azif’s defence at 2pm.

He allegedly committed the offence together with Azmil Ahmad Hassan, 28, who admitted to the charge and was sentenced accordingly and also an accomplice still at large.

The offence under Section 395/34 of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

The prosecution had called five witnesses in the hearing.

Deputy Public Prosecutor Dacia Jane Romanus conducted the prosecution while Azif was not represented.

Pending the date, Azif was further remanded.

Meanwhile, in another court, two men were charged separately with entering the State illegally.

They were Jimmy Nambuk and Abdul Muksin who were appeared before Sessions Court Judge Azreena Aziz.

Jimmy pleaded guilty to entering the State without any identification document and was sentence to four months’ jail.

He was arrested on Oct 25 this year at Kudat area after failing to produce his document to the police.

Jimmy was ordered to serve the jail sentence from the date of his arrest and referred to the Immigration Department for his biometric data to be recorded before deportation.

While, no plea was taken from Abdul pending the availability of Bajau Ubian interpreter and his case will be re-mentioned on Dec 12.

No bail was offered to Abdul pending the date.
