Kota Kinabalu: Three relatives were charged separately with raping and committing sexual harassment against two step-siblings who were also related to the trio.The trio aged 56, 54, and 24, pleaded not guilty separately before Sessions Court Judge Noor Hafizah Mohd Salim to the charges against them.
The 56-year-old man has five charges raping the two alleged victims who were his stepdaughter and biological daughter and another charge of committing physical sexual harassment.
On the first to second count, he is accused of raping the 14-years and six-months-old stepdaughter at 10pm in August and October this year at a house in Sepanggar, near here.
On the third to fourth count, he allegedly raped his 14-years and eight-months-old daughter in October and Nov 28, this year at 10pm at the same place.
The offence, under Section 376(2) of the Penal Code, carries a jail term of between eight and 30 years, and whipping, on conviction.
On the fifth count, the man is accused of committing sexual abuse by fondling the stepdaughter’s breasts at 8pm in August this year at the same place.
The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.
The court set Jan 30, 2023 for pre-trial case management and no bail was offered to the man due to the relationship between him and the alleged victims.
Meanwhile, the 54-year-old has four charges of raping the same alleged victim who was his step-granddaughter (14-years and six-months-old).
On the first to fourth counts, he allegedly raped the step-granddaughter when she was at the ages of 10, 11, 12 and 13 at the same place in Feb 2018, Sept 2019, June 2020, and Sept 2021.
The court set Jan 27, 2023 for pre-trial case management and ordered the man to be remanded further pending the date as the alleged victim was his step-granddaughter.
For the 24-year-old, he is accused of raping the same girl who was his step-niece at 11pm in April this year, also in Sepanggar.
His pre-trial case management had been fixed on Jan 30, 2023 and no bail was offered to him as he was the step-uncle of the alleged victim.
Deputy Public Prosecutor Lim Sze Chuen appeared for the prosecution while the trio were not represented.
