Kota Kinabalu: A 37-year-old man was ordered to enter his defence on a charge of taking syabu repeatedly.
Sessions Court Judge Noor Hafizah Mohd Salim made the order for Kalvin Liew Soon On after ruling that the prosecution had established a prima facie case against Liew on Wednesday.
Liew was ordered to enter defence on Feb 15 this year.
He is accused of taking the drug after his urine allegedly tested positive for drug at the Papar police station at 11pm on Feb 12, 2022.
The charge stated that Liew has several previous conviction records for taking the drug.
The offence under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39C(1) of the same Act provides for a jail term of between five and seven years, and at least three strokes of the cane, on conviction.
The prosecution had called five witnesses during the hearing.
Deputy Public Prosecutor Dacia Jane Romanus conducted the prosecution while Liew was not represented.
