Kota Kinabalu: A 42-year-old driver was sentenced to a total of 52 months jail by the Magistrate’s Court on Tuesday on two counts of keeping stolen vehicles.
Modzmal Mohd Habil was jailed 16 months after he pleaded guilty to keeping a stolen Toyota Liteace van belonging to one Lieu Oi Yun at 10.30am on Jan 1, this year at a car park area near the garbage house, Gaya Street.
Magistrate Stephanie Sherron Abbie heard from the prosecution that the van was reported missing on July 6, last year at Segama here.
On the second count, Modzmal was handed 36 months’ jail after he admitted before Magistrate Jessica Ombou Kakayun to keeping a stolen Perodua Kancil car belonging to one Abdul Karim at 3pm on Jan 6 this year in Manggatal.
The court was informed by the prosecution that the car was reported stolen on Oct 15, last year at Api-Api Centre here.
Each charge under Section 411 of the Penal Code carries a jail term of between six months and five years on conviction.
Duty counsel Lim Ming Zoong @ Lawrence representing Modzmal requested for leniency and told the court that he was the sole breadwinner of his family. Lim also said Modzmal received the stolen van from a friend who asked him to keep it for him.
Jessical ordered Modzmal to serve the sentence from the date of his arrest and concurrently with the jail term on the first count. Inspectors Suzie @ Stephanie Kupit and Albert Basiri prosecuted.
