Bung, wife's graft appeal held up by delay in getting court records
Kinabatangan MP Bung Moktar Radin is charged with receiving bribes amounting to RM2.2 million and RM262,500 as gratification when he was Felcra’s chairman, and his wife, Zizie Izette, is accused of abetting him.
Kuala Lumpur: The Court of Appeal could not fix a hearing date for an appeal by Kinabatangan MP Bung Moktar Radin and wife, Zizie Izette, after the High Court rejected their mode of challenging a sessions court judge’s order calling for their defence on charges of corruption and abetment.

Deputy public prosecutor Law Chin How said the High Court registry has yet to provide the appeal records, which included the written judgment and notes of evidence.

“The Court of Appeal has fixed another case management on March 22,” Law told FMT after an online case management before deputy registrar Khairi Haron today.

He said the parties would appear before trial judge Rozina Ayob on Friday to update her on the status of the case.

In a criminal case, appeal records are prepared by the court once a notice of appeal is filed.

On Dec 9, High Court judge Azhar Abdul Hamid allowed the prosecution’s preliminary objection that Bung and Zizie were wrong to file motions, supported by affidavits, seeking a revision of Rozina’s decision.

The prosecution said the couple ought to have only sent a letter to Azhar to request the review.

Bung faces two counts of receiving bribes amounting to RM2.2 million and RM262,500 as gratification when he was Felcra’s chairman.

He is alleged to have done so to obtain Felcra’s approval to make a RM150 million Public Mutual unit investment in June 2015.

Zizie faces three charges of abetting him.

Rozina had fixed 14 days from Sept 26 until this month for continuation of the hearing after she ordered the couple to enter their defence on Sept 2.
