Guard jailed and fined
Osward admitted to driving a Perodua Viva under the influence of alcohol at 10am on Oct 5, 2019 at Jalan Sepulut-Donggongon-Tambunan, near Kg Rugading, Penampang and collided with a motorcycle, causing serious injuries to Athur O’Brien Clestus.
Kota Kinabalu: A 58-year-old security guard was jailed three years and fined RM8,000 or another two months, Wednesday, for driving under the influence of alcohol which caused an accident with a motorcyclist, four years ago.

Osward Mompungi changed his plea to guilty before Magistrate Jessica Ombou Kakayun to the charge under Section 44(1) of the Road Transport Act 1987.

Osward admitted to driving a Perodua Viva under the influence of alcohol at 10am on Oct 5, 2019 at Jalan Sepulut-Donggongon-Tambunan, near Kg Rugading, Penampang and collided with a motorcycle, causing serious injuries to Athur O’Brien Clestus. The charge stated that a breath test conducted on Osward found he had  216mg of alcohol in 100 ml of blood, more than the set limit which is 80mg of alcohol in 100 ml of blood.

The court was told that Osward failed to control his car and entered the opposite lane at a corner and collided with a motorcycle from the opposite direction.

The motorcyclist suffered a broken bone on his left hand and torn tissue in his right leg and was treated at the hospital.

Counsel PJ Perira, who represented Osward, requested for a lenient sentence on the grounds that it was his first offence, that he has save the court’s time by pleading guilty to the charge and had cooperate with the police during investigations.

Traffic prosecuting officer Inspector Mohd Firdaus Che Mustafa applied for an adequate sentence. The charge provides for a jail term of between three years and 10 years and fine of between RM8,000 and RM20,000, on conviction. Osward was ordered to serve the sentence from Wednesday.

In another case, a 55-year-old man currently serving jail sentence on six counts of various offences was handed another 12 months  and fined RM2,000 or another six months for stealing RM1,000 from a woman. The offence under Section 379 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.

Lovely ordered Karim to serve the sentence consecutively with the jail sentences he is serving for misappropriation of properties and theft. Inspector Kelvan Elson Maik prosecuted.
