Doc assaults another in public
Hanisah, who was not represented, requested leniency and claimed that the complainant owed RM7,000 from her and that she had been trying to contact the complainant but was ignored.
Kota Kinabalu: A doctor was fined RM1,000 or two months’ jail on Tuesday for assaulting her former housemate, also a doctor, at a shopping mall here last month.

Hanisah Rosli, 28, pleaded guilty before Magistrate Stephanie Sherron Abbie to voluntarily causing hurt to one Nur Adlina Afiqah Sa’adan, 29, at 2.40pm on Jan 2, on an escalator at Imago KK Times Square.

The magistrate was informed by the prosecution that on the said day while the complainant was on an escalator, she heard a voice in a state of anger and when she turned towards the voice, she found her former housemate, Hanisah, who then attacked her by pulling her shirt, headscarf and slapping her right cheek.

The attack was dissolved by a security guard.

The complainant, who suffered bruises on her cheeks and scratches on her forehead and cheeks following the attack, lodged a police report four days later on Jan 6.

The court also heard that according to the complainant, Hanisah always disturbed her at her workplace. Days before the report was lodged, she noticed Hanisah’s car at her workplace.

The complainant said that Hanisah also harassed her through WhatsApp everyday and that the incident stemmed from a previous misunderstanding, said the prosecution.

Police investigations revealed that both Hanisah and the complainant were doctors and close friends since 2018 while studying at the university and that their relationship became strained following a misunderstanding at work.

Hanisah said she met the complainant by accident at the said shopping mall.

Inspector Navind Kumar Vijayan, prosecuting, applied for an appropriate sentence.

Hanisah was charged under Section 323 of the Penal Code which carries a jail term of up to one year or up to RM2,000 fine or both on conviction.

In another case, a 29-year-old man, who fraudulently had RM1,000 in his bank account last year, was fined RM100 or two weeks’ jail.

Mohd Azwi Azwanshah admitted before Magistrate Lovely Natasha Charles to having the money belonging to one Jordan Jay, in his CIMB Bank account, on Nov 18, 2022 in Penampang.

The charge stated that Azwi failed to give a satisfactory explanation of how he obtained the money.

The offence, under Section 22A (1) of the Minor Offences Ordinance, provides a fine of up to RM100 or up to three months’ jail, or both, on conviction.

Azwi requested leniency while Inspector Kelvan Elson Maik prosecuting, applied for an adequate sentence.
