Kota Kinabalu: A 27-year-old woman was sentenced to 14 months’ jail, Monday, for cheating a man of RM10,000 over a car sale.
Normiehazieran Abdul Majid, a trader, pleaded guilty before Magistrate Lovely Natasha Charles to having deceived one Md Shahrul Nizam by fraudulently inducing him to make a payment of RM10,000 as a deposit in purchasing a car, which did not belong to her.
The offence took place in November 2022 at Suria Sabah car park.
The charge, under Section 417 of the Penal Code, carries a jail term of up to five years or fine, or both, on conviction.
The court was informed by the prosecution that in November 2022, the complainant saw an advertisement on social media for a Perodua Alza on sale for RM22,000 continue loan and contacted the car seller via WhatsApp.
The complainant then met the seller, later identified as Normiehazieran, at the said place to take the car and signed an agreement and handed over RM10,000 cash in deposit to her, the court heard.
On Dec 16 the same year, while in the car, the complainant was approached by the actual owner of the car, who told him that he had bought his (the real owner) car which was rented to Normiehazieran.
Feeling cheated the complainant then lodged a police report against Normiehazieran.
Unrepresented, Normiehazieran requested leniency.
In another case, a 38-year-old man was jailed five months for keeping a stolen hand drill.
Jamzi Asli admitted to having the stolen tool belonging to Syarikat Emax Synergy Sdn Bhd at 3.20am on Dec 11, 2022 at a store in Alamesra.
The prosecution informed the court that Jamzi was arrested by police on Jan 10 this year following a report lodged on the missing tool from the said place.
Jamzi was charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine, or both, on conviction.
Meanwhile, an Indonesian man was charged with obstructing a police officer from performing his duty.
Taufik Ansari Samsulalam, 32, claimed trial of committing the offence at 12 noon on Oct 22, 2022 at Putatan town.
The charge, under Section 186 of the Penal Code, carries a jail term of up to two years or fine, or both, on conviction.
The court set March 17 for case management and ordered Taufik to be further remanded.
