Kota Kinabalu: A self-employed man, who stole RM664.70 worth of groceries from a supermarket here, was sentenced to five months’ jail on Tuesday.
Rozzaimi Yunnus, 35, pleaded guilty before Magistrate Lovely Natasha Charles to stealing 33 assorted types of food, drinks and baskets at the Bataras supermarket in Wawasan Plaza at 5.30pm on Dec 22, 2022.
Rozzaimi’s case came up for pre-trial case management on Tuesday but he informed the court that he wished to change his plea to guilty.
When asked by the court about his reason for stealing the groceries, Rozzaimi said it was for his family’s own consumption as he has a wife, who was a housewife and six children.
Earlier, Inspector Kelvan Elson Maik, prosecuting, informed the court that Rozzaimi was seen through video surveillance in suspicious behaviour as he stuffed groceries into a trolley and walked out of the premises without paying.
Rozzaimi was detained outside the store and handed to police, the court heard.
Unrepresented, Rozzaimi requested leniency by saying that it was his first offence, which was confirmed by the prosecution, who applied for an adequate sentence.
He was ordered to serve the sentence from the date of his arrest.
The offence, under Section 380 of the Penal Code, carries a jail term of up 10 years and liability of a fine, on conviction.
In another case, a 28-year-old woman was fined RM1,200 or two months’ jail for engaging in gambling activity.
Nursyafiqah Abdullah admitted to committing the offence at 4.15pm on Feb 12, this year at the five-foot-way of a shop at Taman Suria, Jalan Penampang.
The court heard from the prosecution that police, during Ops Dadu, detained Nursyafiqah for conducting an online gambling activity and found a handphone on her which has the online gambling app.
The charge, under Section 7(2) of the Common Gaming House Act, provides for a fine of up to RM5,000 or up to six months’ jail ,or both, on conviction.
