Kota Kinabalu: A 46-year-old man, currently serving jail sentence in prison, was on Tuesday sentenced to three years’ jail for burglary.
Mohd Azni Sarni pleaded guilty before Magistrate Lovely Natasha Charles to breaking into a house at Taman Megah Kobusak, Penampang, to steal, at 11.pm on Nov 9, 2022.
Azni committed the offence along with two accomplices still at large.
Prosecuting Officer Inspector Kelvan Elson Maik told the court that the house owner realised his house was being broken into by three unknown men and shouted for help from the neighbour but the three fled through the back fence.
The complainant then found a house key and a car key missing from his house.
Azni was arrested by police after his fingerprints were extracted from the house, said the prosecution.
He was charged under Section 457 of the Penal Code which carries a jail term of up to 14 years and liability of a fine on conviction.
Counsel Lim Ming Zoong @ Lawrence requested a lower sentence for Azni on the ground that he is married with four children and that he is currently serving 12 months in jail for a similar offence.
The court ordered Azni to serve the sentence consecutively with his present jail term.
