Jailed for violating RR order
Linus had committed the offence at the Donggongon roadside in Penampang at 11pm on Oct 14, 2022.
Kota Kinabalu: A 47-year-old man who was placed under a Restraining Order under the Dangerous Drugs (Special Preventive Measures) Act 1985, was on Wednesday jailed three years jail for violating the order.

Linus Peter Ragut pleaded guilty before Magistrate Stephanie Sherron Abbie to having violated a restriction order under Section 6(3) of the Dangerous Drugs (Special Preventive Measures) Act 1985, which required him to be in the house in the area where he is restricted from 8pm and 6pm, unless he gets the permission of the district police where he is restricted.

Earlier, Linus, whose case came up for trial on Wednesday informed the court that he wished to plead guilty to the charge under Section 6(7) of the Dangerous Drugs (Special Preventive Measures) Act 1985.

He had on Oct 26, last year claimed trial to the charge which provides for an imprisonment term of not less than three years and not exceeding five years, on conviction.

Duty counsel Carmen Khoo requested a lenient sentence because Linus was remorseful and married with seven children and was the sole breadwinner of his family.

Linus was ordered to serve the sentence from the date of his arrest.

In another case, a single mother of two was fined RM2,500 or eight months jail for shoplifting.

Alijah Abdul, 28, an IMM13 holder, admitted to stealing three units of hair dye, cologne, hair and body wash and a body wash bar worth RM65 at the CKS Grand Millennium Supermarket in Penampang at 10.30am on April 1, this year.

She was charged under Section 379 of the Penal Code which carries a jail term of up to seven years or fine or both, on conviction.

According to the facts of the case presented by the prosecution, Alijah was arrested by the security guard who found the seven items in Alijah’s bag, and that she failed to produce a payment receipt for the items.

She was subsequently handed over to the police.

Alijah, who was not represented, requested a lower fine and told the court that she was a single mother with two small children and that her document is valid until Oct 2 this year.

Meanwhile, a 19-year-old unemployed man was tentatively charged with drug trafficking.

Zulariffin Musabta was accused of trafficking 52.80gm of syabu at 4.30pm on March 21 this year at an open space on a hill of Kg Lok Buno, Sepanggar, Manggatal.

However, no plea was taken from Zulariffin after the charge was read out to him.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.

The prosecution applied for a new mention date while waiting for the chemist’s report and objected to bail for the accused as the charge has no provision for bail.

Stephanie fixed May 18 for mention and ordered the accused, who was not represented, to be further remanded.
