Kota Kinabalu: A former Sukma rugby player was fined RM1,300 or three months jail on Wednesday for assaulting a man whose car he had blocked at a residential parking lot in Penampang, last year.
Ian Cliff Rampangajouw, 23, pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to Ahmidin Jiffar, 51, by punching his nose at 7.28am on June 2, 2022 at Phase 2, Block G, Beverly Hills Apartment, Jalan Bundusan.
Inspector Kelvan Elson Maik, prosecuting, in tendering the facts of the case, informed the court that the complainant, Ahmidin, lodged a police report that an argument had taken place between him and a resident of Block E, as the man’s car had blocked his path.
As a result of the argument, the individual, later identified as Ian, approached the complainant and punched him in the nose and mouth, causing bruises and bleeding.
The offence under Section 323 of the Penal Code carries a jail term of up to one year, up to RM2,000 fine, or both, on conviction.
Counsel Julhamri Jumhani requested leniency on the grounds that Ian who works as a mechanic and represented Sabah in last year’s Sukma has no previous conviction record.
Ian also expressed profound apology and regretted his action as he got caught up in the moment during the incident, said Julhamri. The prosecution applied for an adequate sentence.
In another case, an unemployed man was charged with trafficking 113.09gm of 3,4-Methylenedioxymethamphetamine (MDMA).
Aldwin Au Yong Hong Kiet, 25, was accused of committing the offence at 9.30pm, on April 11, this year at B1 parking lot, Sutera Avenue here.
However, no plea was taken from Au after the charge was read out to him.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.
The prosecution applied for a new mention date pending the chemist’s report and objected bail for Au as the charge against him has no provision for bail.
Au was also accused of having 24.30gm of ketamine at the same place and time as framed under Section 12(2) of the same Act. No plea was taken from him pending the chemist’s report.
The court set June 7 for mention of the case and ordered Au to be remanded further.
