Kota Kinabalu: A 43-year-old Filipino labourer was jailed a total of 36 months on Wednesday on four counts of disposing of stolen gold jewellery.
Murbi Ahmad, an IMM13 holder pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at separate locations, here, last year. He was jailed nine months jail on each count and to run from the date of his arrest.
Murbi, whose case came up for pre-trial case management Wednesday, informed the court that he wish to change his plea to guilty to each charge under Section 414 of the Penal Code.
He admitted to disposing of a stolen gold ring and a gold bangle at Kedai Emas Koperasi Usahawan Tawau Berhad at Kg Air, at noon on Aug 30, and a gold necklace with its gold pendant at Kedai Pajak Emas 88 Sdn Bhd at Sinsuran, at 1pm on Aug 29.
Murbi also pleaded guilty to disposing of two gold rings and a pair of gold earrings at Kedai Pajak Gong Hi Sdn Bhd, Segama at 1.20pm on Aug 29 and disposing of a stolen gold bracelet at Kedai Pajak Gadai Ehsan Kinabalu at Segama at 1.55pm on Aug 29.
Each count under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.
The court heard from the prosecution that Murbi together with three accomplices went to the city in which Murbi was the one who went to pawn all the gold jewellery.
The proceeds of the gold pledge amounting to RM12,000 were divided between them and each of them got RM3,000, said the prosecution.
Unrepresented, Murbi requested leniency by saying that he has 10 children and that his wife is currently pregnant and he was the sole breadwinner of his family.
He was ordered to be referred to the Immigration Department after serving the sentence.
In another case, a 36-year-old man was sentenced to five months jail for having stolen items.
Md Runnie Roslan, a general worker admitted to having 28 types of hardware tools belonging to Mr DiY shop at 11.20pm on March 19, this year at Inanam bus terminal.
He was charged under Section 411 of the Penal Code which carries a jail term of up to five years or fine or both on conviction.
Duty counsel Carmen Khoo, representing Runnie applied for a lenient sentence.
