Kota Kinabalu: A 36-year-old self-employed was charged in the Magistrate’s Court here Friday with trafficking 408.84gm of syabu.
Mohd Mardisyah Mohd Din was accused of committing the offence at 4.15pm on April 15, this year at an open land next to a fuel kiosk in Rampayan, Manggatal.
However, no plea was taken from Mardisyah, who appeared before Magistrate Lovely Natasha Charles after the charge was read out to him.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.
The prosecution applied for a new mention date pending the chemist’s report and objected bail for the accused as the charge against him has no provision for bail.
Lovely fixed June 6 for mention.
Mardisyah was also charged with taking drugs under Section 15(1) of the Dangerous Drug Act which provides for a fine of up to RM5,000 or up to two years in jail on conviction.
No plea was recorded from him pending the chemist’s report.
The court set June 7 for mention of the case.
Mardisyah was not represented.
Meanwhile, three men were penalised for having syabu.
Fasir Faisal, Bernadus and Benre Madrang pleaded guilty to having syabu weighing 0.01gm, 0.02gm and 0.76gm, respectively between Jan 3 and Feb 28, this year at separate locations in Manggatal, Inanam and Sepanggar.
Fasir was fined RM2,700 or 10 months’ jail, Bernadus was jailed one day and fined RM1,700 or six months’ jail while Benre was handed 11 months’ jail.
The three were charged under Section 12 (2) of the Dangerous Drug Act 1952 which provides for a fine of up to RM100,000 or up to five years’ jail or both on conviction.
