Products containing poisons: Shop owner fined RM6,500
The offence was framed under Section 13 (a) of the Poisons Act 1952.
Kota Kinabalu: A shop owner was fined a total of RM6,500, Monday, on three counts of illegally having for sale products containing poisons and selling unregistered products and cosmetics without notification, four years ago.

Norain Been, 30, pleaded guilty before Sessions Court Elsie Primus to all offences committed at 2.30pm on Oct 9, 2019 at Norain Enterprise, Kg Kepayan in Penampang.

On the first count, Norain was fined RM3,000 or a month’s jail for having for sale 11 units of ‘Candy B+ Complex’, six units Soloco, five units ‘Catuaba’, seven units ‘Double Coconut’ which all detected to contain Tadalafil, a poison listed under the First Schedule of the Poisons Act 1952, and 46 units ‘Tissue Super Magic Man’, which contained Lignocaine, also listed in the First Schedule of the same Act.

The offence was framed under Section 13 (a) of the Poisons Act 1952.

On the second count, Norain was fined RM2,000 or a month’s jail for selling eight unregistered products namely 11 units of Candy B+ Complex, nine capsules of Vmenplus Supplement for Men Gold, 46 units of Freshcare, 15 units of BL and five units of Clobetamil G.

Norain committed an offence under Regulation 7(1)(a) of the Control of Drugs and Cosmetics Regulations 1984.

On the third count, Norain was fined RM1,500 or a month’s jail for selling 10 units of Colagen Plus Vit E Dan and Night Cream an offence under Regulation 18A(15) of the Control of Drugs and Cosmetic Regulations 1984.

Meanwhile, a company was fined RM2,000 for participating in the broadcasting of an advertisement without the approval of the Medicines Advertisement Board.

Faezah Healthcare Sdn Bhd represented by its director admitted before Judge Azreena Aziz to committing the offence by spreading an advertisement titled “Drive Thru Covid-19 Test, 8am-8pm, RTK antigen RM60, Saliva Test RM50, RT PCR RM200, 0128514847” in the form of a banner that refers to services related to diseases, namely: Covid-19 and which induces or contains an invitation, whether express or implied to any person referred to in the advertisement in connection with the service.

The offence took place at noon on March 3, 2022 at the parking bay at Api-Api Centre here.

The company had violated Section 4A of the Medicines (Advertisement & Sale) Act 1956 and Regulations.

Prosecuting officer of the Pharmacy Department Amira Diyara Rosman and Lavinia Kong Jin Qi prosecuted.
