Kota Kinabalu: The amended Sabah Labour Ordinance is expected to reach conclusion by year end, said Deputy Human Resource Minister Mustapha Sakmud.
Since its last amendment in 2005, discussions have been carried out with employers, non-governmental organisations and the State Government which have been brought to the Federal level for revision.
He said this matter (ordinance amendment) has not been given attention for almost 18 years, which not only requires attention but also immediate action.
“As I was informed, the Sabah Labour Ordinance was amended in 2005 (previously) and will be amended now.
“It is high time for this course of action to be taken adhering to the Employment Act 1995.
“And this act is the international standard that have been practised in various countries,” he told a press conference after officiating the (8th Borneo Conference and Exhibition on Occupational Safety and Health) BOSH 2023 at Sabah International Convention Centre, Tuesday.
Mustapha said the Sabah Labour Ordinance as well as Sarawak Labour Ordinance are the law based on the Employment Act 1995.
He said amendments on both ordinances followed changes in the Employment Act at the Federal Level.
It was reported that the Employment Act 1995 underwent amendments at least once every decade whereas the Sabah Labour Ordinance failed to go through the same process as the Federal Level.
He the amendments ensure that employees’ rights are protected and get the same benefits as workers in Peninsular Malaysia.
“The State Government has agreed to it (amendment) and it has also been decided by the (State) Cabinet. Which then is brought to the Attorney General (AG) for revision.
“It is currently under review and we do hope that the amended ordinance will be implemented before year end.
“It has been refined with discussions between the government, employers and trade unions in Sabah taking into account the economic aspects and
the reality of Sabah’s development,” he said.
