Kota Kinabalu: A woman who was charged with cheating a woman of RM895,000 over investment in food truck business was freed from the charge by the Magistrate’s Court.
Magistrate Jessica Ombou Kakayun discharged and acquitted Sylvia Joan Mansul without her defence being called.
Jessica in delivering her ruling held that the prosecution had failed to prove a prima facie case against the accused.
Sylvia was accused of cheating Janetta Masudal @ Bernadine by making her to believe that she (Sylvia) was offering a food truck business investment and dishonestly made Janetta hand over RM895,000 cash as capital for the business to her.
The offence allegedly took place at 2pm on Sept 2016, in a house at Teck Guan Villa, Mile 3, here.
Sylvia was on Feb 28, 2019 claimed trial to the charge under Section 420 of the Penal Code.
Seven witnesses were called to testify during the prosecution stage.
Deputy Public Prosecutor DK Afiqah Alya prosecuted while Slyvia was represented by counsel Ram Singh, Kimberly Ye and Chen Wen Jye.
