Kota Kinabalu: A 33-year-old man was fined RM7,000 or 48 months jail by the Traffic Court here for displaying a fake road tax on his van three years ago.
Md Nazrie Mohd Noor pleaded guilty before Magistrate Jessica Ombou Kakayun on Monday to committing the offence with the intention of deceiving the authorities at 11am on Nov 13, 2020 at Jalan Pintas, Penampang.
The charge under Section 108(3) (e) of the Road Transport Act 1987 provides for a fine of between RM5,000 and RM20,000 or a jail term of between one year and five years or both, on conviction.
Traffic prosecuting officer Inspector Mohd Firdaus Che Mustafa informed the court that Nazrie, who bought the van from a friend by way of a loan extension in 2017, could not renew the road tax when it expired in Dec 2019 and had used a runner service by paying RM500 to get a fake road tax and affixed it on the van’s windshield.
In Sept 2020, Nazrie sold the van to a friend by way of hire purchase but no letter of agreement was made.
Nazrie’s friend was detained by police at Jalan Pintas on Nov 13, 2020 for being suspected of using fake road tax and when referred to the Road Transport Department found indeed the road tax was fake.
Unrepresented, Nazrie requested a lower fine while the prosecution applied for an adequate sentence.
In another case, an unemployed man was tentatively charged with trafficking 50.80gm of syabu.
Undocumented Azman Idzham Yamin, 24, was accused of committing the offence at 2pm on June 16, this year at Kg Tebobon, Manggatal.
However, no plea was taken from Azman, who appeared before Magistrate Stephanie Sherron Abbie after the charge was read out to him.
The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.
The prosecution applied for a new mention date pending the chemist’s report and objected to bail for Ahmad as the charge against him has no provision for one.
The court set Aug 23 for mention and ordered Ahmad to be further remanded.
