Kota Kinabalu: A 54-year-old man pleaded not guilty in the Magistrate’s Court here to assaulting his wife.
Jackson Koh Kok Fah, who appeared before magistrate Stephanie Sherron Abbie, was accused of voluntarily causing hurt to his wife by strangling her neck causing pain on Aug 5 at a house in Penampang.
He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.
Section 323 carries a jail term of up to one year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable upon conviction for that offence.
Inspector Suzie @ Stephanie Kupit proposed bail at RM5,000 in two sureties.
Counsel Sylyester Kuan, representing Koh, applied for a lower bail amount on the ground that he is the sole breadwinner of his family of five.
The court set Sept 4 for pre-trial case management and released Koh on a bail of RM1,800 in two sureties.
Meanwhile, another man was charged with obstructing a police officer from carrying out his duty.
Quek Jo Haw pleaded not guilty to committing the offence on July 21, 2022 in a café at Suria apartment in Penampang.
Quek informed the court that he needed to get a lawyer as he was not familiar with legal terms.
The prosecution in applying for a case management date proposed bail at RM5,000 in two sureties.
Stephanie set Sept 4 for pre-trial case management and offered the accused bail at RM1,800 in two sureties.
The charge under Section 186 of the Penal Code carries a jail term of up to two years or fine or both, on conviction.
In another case, four people were penalised for committing drug-related offences.
Damsi Raham pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazal to having 5.07gm of syabu on June 17, 2022 at Inanam town.
He was sentenced to two years in jail and ordered to be caned three times.
The charge under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
Another three men, Victor Kinsung, Sofey Masaid and Siri Taran admitted to taking drugs here between April 30 and June 8.
They were each jailed seven months.
Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years’ jail, on conviction.
