Kota Kinabalu: An unemployed man was fined RM2,000 or three months jail by the Magistrate’s Court here for punching his aunt’s face.
Muhammad Zulaizam pleaded guilty before Magistrate Wan Farrah Farriza Wan Ghazali to voluntarily causing hurt to Jamilah Matjin, 69, at 12.45pm on Aug 21 at a stilt house in Kg Tanjung Aru Lama.
The court was informed by the prosecution that prior to the incident, the victim came to the house and asked her younger brother’s family, including Zulaizam, when they would be moving out of her house there.
Zulaizam punched the victim’s face before a struggle ensued between them.
Police investigations revealed that the victim had given permission to her brother to stay temporarily in the house after her brother’s house was destroyed in a fire.
The victim’s brother and his family then left the house after the incident, said the prosecution, adding that the victim who suffered injuries on her face and left arm, was sent to the hospital for treatment by her daughter-in-law.
Counsel Carmen Khoo, representing Zulaizam, requested a lenient fine on the ground that he was remorseful.
Zulaizam was charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.
Meanwhile, a 20-year-old man was fined RM3,500 or three months jail for stealing a handphone worth RM2,500 from a woman.
General worker Mohd Nazrin Sahlan admitted to stealing the gadget from Maisuri Akbar at the car park of Bataras Supermarket in Kingfisher at 3pm on Aug 19.
The prosecution told the court that prior to the incident, the complainant was resting in the car and placed the phone on her chest.
Suddenly an unknown man yanked the mobile phone from outside while the complainant was lowering the car window.
The complainant’s husband chased the man, later identified as Nazrin, and was arrested by patrolling police.
However, the handphone could not be found, the court heard.
Duty counsel Khoo, representing Nazrin, applied for a lenient sentence.
Nazrin was charged under Section 379 of the Penal Code which carries a jail term of up to seven years or with fine, on conviction.
In another case, six people were penalised for committing drug-related offences.
Five of them Masrah Jepang, Md Faizal Mursidi, Jani Bulagas, Md Aldanial and Rahman Moktar pleaded guilty to taking syabu at separate locations here and in Penampang between June 20 and July 3.
Masrah and Aldanial were each fined RM2,000 or five months jail, Jani and Rahman were handed six months jail while Faizal was jailed five months.
Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
Mohd Haszarul Hezam was fined RM2,900 or nine months jail after he admitted to having 0.11gm of syabu in Kg Air on June 28.
He was charged under Section 12 (2) of the Dangerous Drugs Act 1952 which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
