Kota Kinabalu: A 28-year-old parolee was sentenced to 12 months’ jail by the Magistrate’s Court for absconding before the expiry of the Parole Order under Section 46N(3) of the Prison Act 1995.
Shazwan Jani pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence and failing to comply with any of the conditions of the Parole Order issued to him at 12.35am on Feb 16, this year at the City Top Enterprise Sdn Bhd’s employee dormitory, Mile 5, Jalan Tuaran, Inanam.
The offence is punishable under Section 46N(3) of the Prison Act 1995 which carries a jail term of up to two years, on conviction.
Earlier, the court was informed by the prosecution that Shazwan was found to have violated the conditions of the parole order when he was not found at the dormitory by the parole officer and failed to be found after a search was made around Inanam area.
Shazwan was later arrested by police on June 10 for an offence under Section 413A of the Penal Code.
Unrepresented, Shazwan requested leniency while the prosecution applied for an adequate sentence.
In another case, two people were jailed eight months each for committing mischief by cutting 30 metres long of an overhead cable.
Albert Abel, 31, and Nor Syuhadah Basik, 23, both jobless admitted to cutting the cable belonging to Telekom Malaysia at 5.40am on Aug 28 at Jalan Lorong Unta 6, Taman Fu Yen, Luyang.
They committed the offence along with an accomplice still at large.
The charge under Section 431A of the Penal Code carries a jail term of up to two years or fine or both, on conviction.
According to the prosecution, Albert, Nor and their accomplice were seen winding up the cable that had been cut before two of them were detained by the company’s workers.
The duo’s act had caused the interruption of telephone and internet supply in the said area, the court heard.
