Woman loses RM1k for fighting in public
“I was so angry that I slapped her,” said Jaivie.
Kota Kinabalu: A 33-year-old woman was fined RM1,000 or two months jail on Thursday for fighting in public last year.

Jaivie Punchki pleaded guilty before Magistrate Stephanie Sherron Abbie to committing affray to the point of disturbing public order at the Magma office in Damai, at 10.20am, on Oct 18, 2022.

Jaivie was jointly charged with another accused, 41-year-old Hildah Ensil, who claimed trial to the charge.

The charge under Section 160 of the Penal Code carries a jail term of up to six months or fine of up to RM1,000 or both, on conviction.

The court fixed Oct 26 for mention of Hildah’s case and offered her bail at RM500 in two sureties.

The prosecution in tendering the facts of the case, told the court that based on video surveillance, Jaivie was found to have hit the complainant first who responded by hitting her back before a fight broke out between them.

The complainant suffered injuries on her face while Jaivie did not suffer any injuries, the court heard.

Police investigations revealed that the incident occurred due to dissatisfaction over work matters.

Unrepresented, Jaivie requested a lenient sentence and told the court she has since been laid off after the incident and is now working at a club in Tawau and taking care of her child as well as mother.

When asked about the reason for committing the offence, Jaivie said the complainant had scolded her and insulted her in front of other staff.

“I was so angry that I slapped her,” said Jaivie.

Earlier, the prosecution offered Hildah bail at RM4,000 while her counsel Sharonne Noivont applied for a lower bail on the grounds among others, that she is married with three children.

Meanwhile, a labourer was fined RM25 or a day’s jail for having tools with the intention to commit an offence.

Mohd Aqzeril Alfian admitted to having four rolls of wires, a screwdriver and a wire cutter at 5.30pm on Sept 9 in front of premises at Kg Contoh, Petagas, Jalan Putatan.

The court was told that Aqzeril was arrested by police for being involved in a copper theft case and that the said tools were found with him.

He was charged under Section 21(h) of the Minor Offences Ordinance which provides for a fine of RM50 or a jail term of up to three months or both on conviction.

Duty counsel Lim Ming Zoong @ Lawrence representing Aqzeril applied for a lenient fine.
