Kota Kinabalu: A 63-year-old man was ordered to enter his defence on two of the three charges of committing sexual harassment against his niece.
Sessions Court Judge Amir Shah Amir Hassan, however, discharged and acquitted the man on one of the charges.
In making the decision to order the man to enter his defence for the first and third counts, the court ruled that the prosecution had established a prima facie case against him. The court set Oct 23 this year for the man’s defence.
On the first and third counts, the man is accused of committing the offences against the six-year-old girl by making the minor touch his private part and inserting his finger into the minor’s anus.
The alleged incident took place in September and November 2019 at two separate houses in Likas and Papar.
For the second count, the man was accused of committing the offence against the same minor by kissing her lips in September and November 2019 at a house in Likas.
The prosecution had called nine witnesses in the hearing.
Deputy Public Prosecutor Dacia Jane Romanus conducted the prosecution while counsel Datuk Seri Rakhbir Singh defended the man.
