Kota Kinabalu: A 19-year-old was charged in the Magistrate’s Court, Tuesday, with trespassing into a house here.
Ahmad Arsyad Arzani pleaded guilty before magistrate Lovely Natasha Charles to trespassing into the house at Jalan Kuala Laut, Likas, belonging to one Siti Maria Ariffin at 6am, on Sept 25, this year.
The charge, under section 448 of the Penal Code, carries a jail term of up to three years or a fine of up to RM5,000, or both, on conviction.
However, the court adjourned sentencing to Nov 22 pending Ahmad’s social report.
The court heard from the prosecuting officer Inspector Kelvan Elson Maik that the victim noticed the light in her rental room had been turned on after she had sent her children to school that morning.
Concerned for her safety, the victim then called the police. The police opened the door and discovered Ahmad sleeping in the room. He was subsequently apprehended by the police, said Kelvan.
According to Kelvan, the initial investigation revealed that the victim never gave permission to Ahmad to stay in the room, nor had he sought permission from the victim to occupy it.
It was also found that three Nako glass pans had been removed. It is believed that Ahmad broke into the room through the window since the door was locked.
Duty Counsel Lim Ming Zoong @ Lawrence, representing the Ahmad, considered Ahmad as a youthful offender and Ahmad requested for a social report to be prepared.
Kelvan proposed bail at RM3,000 with two sureties. However, Lim requested to lower the bail amount.
Lim also said that Ahmad works as a car washer and that he resides with his mother as his parents were divorced.
The court released Ahmad on a bail of RM1,000, with no deposit on one surety.
In the same court, two men were sentenced for having syabu.
Shafizam Sukiman, 39, pleaded guilty for having 0.05gm of syabu at Kingfisher parking on June 26 and was sentenced to 11 months’ jail from the date of his arrest.
Muhammad Aldanial Maslin, 19, also peladed guilty to having 0.13gm syabu at Kampung Petagas and was fined RM2,600 or seven months’ jail.
They were charged under Section 12(2) and Section 12(3) of the Dangerous Drugs Act (ADB) 1952 which provides for a fine up to RM100,000, or up to five years’ jail, on conviction.
Duty counsel Lim, defending Aldanial, requested for a lenient sentence as he is first-time offender.
For Shafizam, duty counsel Carmen Khoo also requested for a lenient sentence as he is a divorcee with two children, aged 12 and 8 years old and works as a driver with an income of RM2,000.
Kelvan applied for a deterrent sentence for both Aldanial and Shafizam.
